We investigate two under-explored factors in mitigating the risk of corporate fraud and regulatory enforcement against fraud, namely institutional investors and political connections. The role of institutional investors in the effective monitoring of a firm’s management is well established in the literature. We further observe that firms that have a large proportion of their shares held by institutional investors have a lower incidence of enforcement actions against corporate fraud. The importance of political connections for enterprises, whether in a developed market (...) such as the United States or an emerging market such as China, has been established by previous studies. However, we find evidence of another positive effect of political connections: they may reduce the incidence of enforcement action against corporate fraud. We also find that political connections play a more significant role in reducing regulatory enforcement incidents against non-state-owned enterprises and firms in weaker legal environments, whereas institutional ownership plays a more important role in reducing regulatory enforcement incidents against state-owned enterprises. In a letter, dated August 11 1936, to the editor-in-chief of Theoria, Åke Petzäll, the Finnish philosopher Eino Kaila claimed that it was only a matter of time until the journal Erkenntnis would be closed down and suggested that Theoria could step in as (...) a replacement. Research Ethics, Volume 18, Issue 4, Page 265-280, October 2022. Concerns around comprehension and recall of consent information by research participants have typically been associated with low health and research literacy levels. In genomics research, this concern is heightened as the scientific and ethical complexities of genetics research, such as biobanking, genetic susceptibility, data sharing, and incidental findings may be more difficult for potential research participants to understand. However, challenges to research participants’ comprehension of consent information may be compounded by (...) factors beyond health and research literacy levels. To identify factors that may impact research participants’ understanding and recall of consent information, we designed a qualitative study to explore whether participants enrolled in a tuberculosis genetics study in Cameroon understood the objectives of the study, the risks and benefits and certain key aspects of the study such as biobanking and data sharing. The results showed that research participants had limited understanding and/or recall of the TBGEN-Africa study goals and methods. Some participants were of the opinion that TBGEN-Africa was not a genetics study because tuberculosis is not an inheritable condition. Factors that may have hindered understanding and/or recall of study information are diagnostic misconception, and information overload and situational vulnerability. There is a need for improved practices to support research participants’ understanding of consent information in genetics studies including designing the consent process in ways that minimize psychological distress and diagnostic/therapeutic misconception. This article discusses the meanings of “creativity”—tvorchestvo—as we encounter it in Georges Florovsky’s thought, first and foremost in his magnum opus Ways of Russian Theology (1937). Tvorchestvo had by this time become a key concept in Russian pre-revolutionary and later émigré thought. It is associated above all with Nikolai Berdyaev’s philosophy, but it also plays an important role in Sergei Bulgakov’s philosophy of economy. In both cases, it stands for the human response to divine creation. Moreover, and somewhat less famously, (...) it was also an epistemological concept in the religious idealism of Vladimir Solovyov as well as in Russian neo-Kantianism (Fyodor Stepun), where it stood for the active, synthetic faculty of our minds. Florovsky, meanwhile, used it as a description of how we should relate to the patristic heritage, but also to history more generally: Our attitude should be “creative,” active, as well as both backward- and forward-looking. This “return to the Fathers” was a central component of Florovsky’s neopatristic program, but, interestingly, in order to conceptualize this return, Florovsky took over a concept from traditions that his own approach otherwise firmly criticized. By analyzing Florovsky’s use of tvorchestvo, this article addresses the broader question as to the differences and parallels between the neopatristic movement and the legacy of the Russian Renaissance (Silver Age). Christian ethics accentuates in manifold ways the unique character of human nature. Personalists believe that the mind is never reducible to material and physical substance. The human person is presented as the supreme principle, based on arguments referring to free-willed actions, the immateriality of both the divine spirit and the reflexive capacity, intersubjectivity and self-consciousness. But since Darwin, evolutionary biology slowly instructs us that morality roots in dispositions that are programmed by evolution into our nature. Historically, Thomas Huxley, “Darwin's bulldog,” (...) agreed with Darwin on almost everything, except for his gradualist position on moral behavior. Huxley's “saltationism” has recently been characterized by Frans de Waal as “a veneer theory of morality.” Does this mark the end of a period of presenting morality as only the fruit of socialization processes (nurture) and as having nothing in common with nature? Does it necessarily imply a corrosion of personalist views on the human being or do Christian ethics have to become familiar again with their ancient roots? (shrink)

In a mathematical perspective, neighborhood models for modal logic are generalized quantifiers, parametrized to points in the domain of objects/worlds. We explore this analogy further, connecting generalized quantifier theory and modal neighborhood logic. In particular, we find interesting analogies between conservativity for linguistic quantifiers and the locality of modal logic, and between the role of invariances in both fields. Moreover, we present some new completeness results for modal neighborhood logics of linguistically motivated classes of generalized quantifiers, and raise new types (...) of open problem. With the bridges established here, many further analogies might be explored between the two fields to mutual benefit. (shrink)

Abraham J. Malherbe was one of the most influential New Testament scholars of the past half century. He is especially known for his use of Hellenistic moral philosophy in the interpretation of New Testament texts, especially Pauline literature. Whilst the comparative study of New Testament and Greco-Roman material remains a contentious approach in scholarship, Malherbe’s work provides important pointers in how to make such comparisons in a meaningful and reasoned manner, by paying due respect to the integrity of the texts (...) being compared and to the function textual elements have within their own contexts. I discussed the salient features of Malherbe’s approach, focusing in particular on his study of topoi. One of the most significant findings was Malherbe’s emphasis on the dialectical combination of common and individual elements in such topoi, which enabled ancient authors to embed their own texts within the cultural discourse of their time. His approach opens the way to further research of the New Testament within its philosophical context without requiring proof of a genealogical relationship between the texts or authors concerned. The article discusses the notion of culture as it appears and is conceptualized in the works of G.P. Fedotov. The analysis focuses on two articles by Fedotov published in Russian migr journals, "The Holy Spirit in Nature and Culture" of 1932 and "Eschatology and culture" of 1938, and in his magnum opus in a Western context, The Russian Religious Mind of 1946. The author proposes to analyze Fedotov's ideas as a theology of culture due to the profoundly religious meaning the (...) Russian migr thinker attributed to cultural products and production, regardless of their religious intention. By implication, Fedotov understood culture in a religious framework as the human experience of and response to the divine, though not necessarily as dependent on firm belief. Viewing Fedotov as a theologian of culture enables us, furthermore, to compare him with other thinkers across the West-East cultural gradient, most notably Paul Tillich. This approach contextualizes Fedotov in a post-Schellingian pan-European idealist tradition, to which Russian thinkers' analyses of religious experience and imagination have made seminal contributions, in particular from Vladimir Solov'ev on. The article discusses these issues within the framework of the perspectives of global intellectual history, entangled history, and transnationalized Russian studies. (shrink)

In the post-Soviet context, various cyclical models of recurrent Russian “Times of Troubles” have become increasingly popular. This perspective emerged first in Soviet dissident circles, who used it as a means to expose as mistaken the Soviet belief in continual historical progress on Russian soil. In post-Soviet Russia this critical approach has been continued by members of the “Akhezier circle,” the economist Egor Gaidar, and others. Meanwhile it was given an affirmative, conservative reinterpretation by Aleksandr Panarin, according to whom Russia (...) has always managed to overcome its phases of devastating Westernization and state collapse. This idea of Russian history has become influential; even Vladimir Putin has talked about Russia as a strong state able to survive various “Times of Troubles” from the early seventeenth century to the early post-Soviet period. It also figures prominently among members of the neoconservative Izborsk Club. This article analyzes different conceptions of Russian history as cyclical and their prominent place in the prevailing civilizational discourse of post-Soviet Russia. By means of postcolonial perspectives, this discourse is seen on the one hand as an attempt to question and reject Western hegemony, attempts that on the other hand nevertheless seem unable to liberate themselves from a normative dependence on the West. This article reinterprets the Dialectic of Enlightenment as a retelling of the Christian myth of the Fall. Through its account of the aporia, which Horkheimer and Adorno maintain stands at its core, the Dialectic of Enlightenment rearticulates the doctrine of original sin. The human condition is presented as tragic, and the source of this tragedy is inscribed into the very structure of human subjectivity. While the Dialectic of Enlightenment refuses to abandon hope, emancipation is reconceptualised on the model of redemption; (...) a kind of fulfilment of human nature, which would at the same time be an escape from it. Horkheimer and Adorno dispense, however, with any transcendent source of grace. Instead, the activity of philosophy itself takes on redemptive quality. (shrink)

Has art still something to do with aesthetics? Traditional aesthetic theories were abandoned under influence of the arguments of Morris Weitz. It seems that there is no longer a place for aesthetics in the philosophy of art. Furthermore, a lot of contemporary art seems to be radically anti-aesthetic. It is argued that there is nonetheless a central role to be played for aesthetic experience in art.

The article argues against the tendency to reaffirm Catholic social thought as Catholic “doctrine” and proposes a reinterpretation in view of the participation of the Church in the transformation of the world. Revisiting Chenu’s critique of Catholic social thought as ideology, the article argues for a reinterpretation of Catholic social thought as Catholic social and ecological discernment in response to the contemporary megacrisis. In one of the most noteworthy and criticized articles from the prominent periodical Foreign Affairs, Samuel Huntington defends the position that the most important geo-strategic problem of the future is the ‘clash of civilizations’. This replaces the older cold war paradigm and the one-sided conceptual model based on relations between states with the paradigm of cultural conflicts. According to Huntington, what ultimately counts for people is not political ideology or economic interests: “Faith and family, blood and belief, are what people (...) identify with and what they will fight and die for.”Despite many nuances, Huntington primarily emphasizes a global cultural conflict between the ‘West and the Rest’ of the world. In broad terms, he speaks of a ‘Confucian-Islamic connection’ that threatens and weakens Western values and power. He has in mind the connection between Islamic and Confucian countries that are quickly becoming industrialized, that are acquiring military as well as economic power, but that are also either unwilling or unable to adapt to Western culture. We could look upon China’s rejection of the universal declaration of human rights for being ‘myopically Western’ as a classic example. (shrink)

From 18 to 20 September 1997, the European Ethics Network held its second annual meeting. The theme this year was ‘Toward a Transdisciplinary Approach to Professional Ethics: Dialogue with the World of the Professions’. In attendance were some eighty participants from diverse European countries.The most important aspect of the second annual meeting was the presentation and discussion about the core materials project for the development of courses in professional ethics. This project involves the writing of European-based learning materials which instructors (...) can use as they develop their own courses and class presentation materials. The core materials project covers four areas: professional ethics in general, business ethics, medical ethics and engineering ethics. In the course of the discussions about the projects, ethicists were joined by non-ethicists, i.e. by representatives from the world of the professions. The presence and feedback from these professionals were welcome additions to this year’s meeting. A complete report and the proceedings from the second annual meeting will be published in an upcoming issue of Ethical Perspectives. (shrink)

People may be subjected to discrimination from a variety of sources in the workplace. In this study of mental health workers, we contrast four potential perpetrators of discrimination (managers, co-workers, patients, and visitors) to investigate whether the negative impact of discrimination on victims’ well-being will vary in strength depending on the relative power of the perpetrator. We further explore whether the negative impact of discrimination is at least partly explained by its effects on people’s sense of organizational justice, and whether (...) the strength of mediation varies according to the source of discrimination. Using survey data from 1,733 UK mental health workers, a structural equation model was designed to test these hypotheses following a bootstrap approach. Discrimination from all sources was related to well-being, with that from managers having the strongest effects. The results support an explanation of the effect of discrimination on well-being in terms of organizational justice perceptions for discrimination from managers and from visitors, but less so for discrimination from co-workers or from patients. The study highlights the importance of differentiating amongst sources of discrimination at work and the salience of organizational justice perceptions in explaining the effects of discrimination from some sources. A straightforward way to handle moral uncertainty is simply to follow the moral theory in which you have most credence. This approach is known as My Favourite Theory. In this paper, I argue that, in some cases, My Favourite Theory prescribes choices that are, sequentially, worse in expected moral value than the opposite choices according to each moral theory you have any credence in. In addition this, problem generalizes to other approaches that avoid intertheoretic comparisons of value, such as My (...) Favourite Option, the Borda Rule, Variance Normalization, and the Principle of Maximizing Expected Normalized Moral Value. (shrink)

Suppose that you prefer A to B, B to C, and C to A. Your preferences violate Expected Utility Theory by being cyclic. Money-pump arguments offer a way to show that such violations are irrational. Suppose that you start with A. Then you should be willing to trade A for C and then C for B. But then, once you have B, you are offered a trade back to A for a small cost. Since you prefer A to B, you (...) pay the small sum to trade from B to A. But now you have been turned into a money pump. You are back to the alternative you started with but with less money. This Element shows how each of the axioms of Expected Utility Theory can be defended by money-pump arguments of this kind. In a recent contribution to this journal Professor A. Argandona explored the general characteristics of corruption and their implications for the corporate sector. Against this background this paper examines one specific form of corruption: the payment of bribes usually by agents of private firms to civil servants and politicians overseas. The paper focuses specifically upon current attempts by western states to criminalise overseas bribery and the problems such efforts are likely to face. Emphasising the centrality of the demand for corrupt (...) payments as well as their supply, the paper concludes by highlighting a pivotal relationship between bribery on the one hand and the abuse of human rights on the other. Using the lens of the idea of “wonder,” I examine the word-image interactions in a selection of engraved representations of the first Montgolfier demonstration for Louis XVI at Versailles. Such a collective close reading first exposes techniques that aim at encouraging admiration in readers (...) for both the new technology and the French state that produced it. However, visual cues in the images indicate a persistent suggestion of doubt and uncertainty—and even fear—as they take readers “up and away” from the confines and comforts of everyday life. The word-image nexus surrounding this spectacle generates an altered textual world in which traditional social and sexual hierarchies lose stability and the future is full of possibility. (shrink)
